The Purpose Of Applying For A Waiver

Not long ago, if you came to the United States and stayed illegally, you were in a bit of a rough spot. In order to be granted permanent residency, you had to go back to your home country to apply for your “green card.” But because you had been in the United States illegally, you had a stiff price to pay: a waiting period of three to 10 years before you could even apply to come back to the U.S. In the meantime, your family here had to find a way to manage without you.

In certain circumstances, when your family would have an undue hardship if you were gone, you could apply for a waiver to eliminate the three to 10-year penalty period. That solved one problem, but did not solve the issue of how long it might take your government to process the waiver — in the meantime, your family was here without you.

Happily, President Obama, issued an executive order that now allows illegal immigrants who are the spouse or child of a U.S. citizen and who would suffer unduly if they were required to leave the U.S. for an extended period, to apply for their waivers from the Unites States, and to remain here, until the waiver is granted.

Upon the waiver being granted, the illegal immigrant will return to their home country to pick up their permanent visa.
